HouseFactor Terms of Service
§1. General Provisions
- These Terms of Use set forth the rules for using the HouseFactor website, available at: housefactor.pl.
- The owner and operator of the Website is Studio Kreacja Przemysław Bazanowski, 15/11 Artura Grottgera St., 63-100 Śrem, Tax ID (NIP): 7851746559, hereinafter referred to as the “Operator” or “HouseFactor.”
- You can contact the Operator:

- HouseFactor is an online advertising platform and search engine for prefabricated, modular, and ready-to-move-in homes, as well as similar housing solutions, that allows users to browse, compare, and search for listings published by manufacturers.
- The purpose of the website is to facilitate contact between people interested in buying a home and home builders; however, HouseFactor is not a party to any agreement entered into between a User and a home builder.
- HouseFactor is not a real estate broker, agent, broker, sales representative of the Manufacturer, or a party to any transaction involving the construction, sale, delivery, or completion of a home.
- The content of the listings—including descriptions, photos, renderings, floor plans, technical specifications, prices, information on availability, promotions, and scope of work—is provided by the Manufacturers and remains their sole responsibility.
- HouseFactor is not responsible for the content of advertisements, the timeliness of offers, the accuracy of developers’ statements, the quality of homes, completion dates, warranties, guarantees, payment terms, advance payments, or other arrangements made directly between the User and the developer.
- By using the Website, you agree to these Terms and Conditions.
- These Terms of Service apply to the entire HouseFactor platform, including the Polish and foreign-language versions of the Website.
§2. Definitions
For the purposes of these Rules and Regulations, the following definitions apply:
- Website – the HouseFactor website, available at housefactor.pl, and its language versions.
- Operator or HouseFactor – Studio Kreacja Przemysław Bazanowski, 15/11 Artura Grottgera St., 63-100 Śrem, Tax ID (NIP): 7851746559.
- User – any person using the Website, in particular a person browsing listings, searching for homes, saving favorite listings, setting up alerts, downloading materials, or sending inquiries to Providers.
- Manufacturer – a business, construction company, or entity offering prefabricated, modular, or ready-to-move-in homes or similar housing solutions that publishes listings on the Website.
- Advertisement – information posted on the Website by the Manufacturer regarding a specific house model, including, in particular, a description, photos, specifications, an estimated price, and other details provided by the Manufacturer.
- Account – a personalized dashboard available after registration and login, allowing you to use select features of the Website.
- Producer Account – an account intended for producers, allowing them to add, edit, and delete listings.
- Inquiry – a message sent by a User via the contact form available with the listing, addressed to a selected Manufacturer.
- Alert – a feature that allows you to receive notifications about new listings that meet specific search criteria.
- Terms of Use – this document setting forth the rules for using the Website.
§3. Nature of the Website
- HouseFactor is a search engine and classifieds platform that brings together listings for prefabricated, modular, and ready-to-move-in homes, as well as similar housing solutions, directly from manufacturers.
- In particular, the service allows you to:
- browsing home listings,
- searching for and filtering job listings,
- comparing home specifications,
- saving favorite listings,
- setting up search alerts,
- sending inquiries to manufacturers,
- downloading materials made available by the Manufacturers,
- use of blog content,
- using the AI Assistant,
- using the features that support the Website’s accessibility.
- Searching for homes, browsing listings, and basic use of the Website by home seekers is free.
- HouseFactor does not sell homes, does not enter into contracts on behalf of manufacturers, and does not accept payments related to the purchase, construction, reservation, or completion of a home.
- All discussions, negotiations, agreements, contracts, advance payments, payments, completion dates, warranty terms, liability for defects, complaints regarding the house, and other matters related to the project’s implementation take place exclusively between the User and the Manufacturer.
- HouseFactor may perform a preliminary screening of inquiries, specifically to assess whether the User is ready to speak with the Manufacturer. This screening does not constitute acting as an intermediary in the transaction or assuming responsibility for the further course of the discussions or the agreement.
- HouseFactor has administrative access to inquiries submitted by Users through the Website. The inquiry is forwarded to the selected Manufacturer at the email address provided by the Manufacturer.
- HouseFactor does not guarantee that the Manufacturer will respond to the User’s inquiry.
§4. Technical Requirements for Using the Website
- To use the Website, you must:
- a device with Internet access,
- a current web browser,
- an active email account if you use forms, accounts, alerts, or the newsletter,
- Enable cookies and JavaScript if they are necessary for the proper functioning of certain features.
- The Operator makes every effort to ensure that the Website operates properly; however, it does not guarantee uninterrupted or error-free access to the Website.
- The Operator has the right to temporarily restrict or suspend access to the Website, in particular due to technical work, maintenance, updates, malfunctions, security concerns, or actions aimed at improving the Website’s operation.
- The user is required to use the Website in accordance with the law, generally accepted standards of conduct, these Terms of Service, and the intended purpose of the Website.
§5. Use of the Website by Users Looking for a Home
- Users can browse and search for listings without creating an account.
- You must create an account to use certain features, such as:
- saving favorite listings,
- setting up search alerts,
- using features that require user identification.
- Users can search for homes based on the criteria available on the Website, such as, in particular, square footage, number of rooms, number of stories, roof type, construction method, number of garages, price, or other parameters.
- Users can compare listings based on the information provided by manufacturers.
- The comparison tool does not store User data unless a particular feature requires the User to log in or unless otherwise specified on the Website.
- Users can send an inquiry to the manufacturer of their choice using the contact form provided with the listing.
- In the contact form, the User provides, in particular:
- first name,
- last name,
- email address,
- phone number,
- Content of the inquiry.
- An inquiry submitted via the form is sent to a single, selected manufacturer.
- A submitted inquiry cannot be canceled through the Website.
- HouseFactor does not store queries in the User or Manufacturer dashboard, unless this feature is implemented in the future and described accordingly on the Website or in legal documents.
- A user may download brochures, PDF files, or other materials related to the home only if the Manufacturer has included such materials in the listing.
- You may need to provide your contact information to download the materials.
- The user acknowledges that all information contained in the advertisement should be confirmed directly with the manufacturer before making a purchase or investment decision.
§6. User Accounts
- A user can create an account on the Website if this feature is available.
- To create an account, you must provide the information requested on the registration form and accept the Terms and Conditions.
- The user is required to provide information that is true, current, and accurate.
- Users may not share their account login credentials with third parties.
- The User is responsible for any actions taken using their account, unless such actions result from circumstances for which the User is not responsible.
- You can delete your account by sending a request to the following email address: kontakt@housefactor.pl or via the online form, if this feature is available on the Website.
- The Operator may suspend or delete a User’s account in the event of a violation of these Terms of Service, applicable laws, the security of the Website, or the rights of third parties.
§7. Producer Accounts
- To post listings on the Website, you must create a Seller Account.
- A Manufacturer Account may be created by an entrepreneur, a construction company, or another entity that offers prefabricated, modular, or ready-to-move-in homes or similar housing solutions.
- This website is intended primarily for manufacturers and companies that offer prefabricated homes. Brokers acting solely on behalf of others may not post listings unless the Operator grants permission to do so.
- A Creator account is activated automatically upon registration, but it may be subject to moderation within 24 hours of creation or at a later time if verification is required.
- The Operator may verify the Manufacturer’s basic registration information, in particular the NIP, KRS, CEIDG, PKD, and KRD numbers, or other publicly available information confirming that the Manufacturer is a legally operating company.
- Manufacturer Verification does not mean that the Operator has verified the quality of the homes, the construction technology, certifications, warranties, the Manufacturer’s financial condition, the completeness of the documentation, the actual availability of the offer, or the accuracy of all information contained in the listings.
- Terms such as “trusted manufacturer,” “verified,” “recommended,” or “premium” refer exclusively to a designation granted by the Operator based on criteria it has established, particularly regarding basic verification of company data, activity on the Website, the completeness of the profile, the scope of cooperation, or other internal criteria.
- The designations referred to above do not constitute a guarantee of quality, an investment recommendation, an assurance regarding the security of transactions, or a confirmation of all information provided by the manufacturer.
- The manufacturer can add, edit, and delete their own listings on their own.
- The manufacturer bears sole responsibility for the data, content, photos, materials, prices, specifications, and information published on the Website.
- The Operator may deactivate a Producer’s Account, restrict its functions, remove a listing, or refuse to publish a listing if the Producer violates the Terms of Service, applicable laws, the rights of third parties, the interests of the Website, or generally accepted standards of conduct.
§8. Rules for Posting Ads
- Manufacturers may post listings for prefabricated, modular, or ready-to-move-in homes, or similar housing solutions.
- The listing should contain accurate, up-to-date, and reliable information about the house being offered.
- When posting an ad, the manufacturer should specify, in particular:
- the floor area of the house,
- the number of rooms,
- the number of stories,
- type of roof,
- construction technology,
- the number of garages,
- photos, renderings, or other visual materials,
- price.
- The price listed in the ad is mandatory; however, it is for reference only and may represent the lowest price for a given home configuration.
- This announcement does not constitute an offer within the meaning of the Civil Code, but is intended for informational purposes and as an invitation to contact the Manufacturer.
- Prices, specifications, scope of work, home availability, technical requirements, materials, promotions, discounts, and other aspects of the offer are subject to change and should be confirmed directly with the manufacturer on a case-by-case basis.
- Photos, renderings, floor plans, and other graphic materials are for illustrative purposes only and do not constitute a commercial offer.
- The manufacturer may post information about promotions, discounts, financing, or phrases such as “starting at,” provided that such information is lawful, accurate, and does not mislead Users.
- The ad must not include the manufacturer’s phone number in the ad text.
- An ad may not contain a link to the Manufacturer’s website, unless the Operator expressly permits such a link as part of a specific feature of the Website or a partnership.
- The manufacturer is required to update its listings on an ongoing basis, particularly with regard to price, availability, specifications, and technical data.
- The operator has the right to correct typos, formatting, categories, labels, or technical elements of the listing, provided that such corrections do not alter the substantive meaning of the information provided by the Manufacturer.
- The Operator has the right to refuse to publish an ad, remove an ad, or restrict its visibility if it determines that the ad is inconsistent with the Website’s profile, the Terms of Service, the law, the rights of third parties, accepted standards of conduct, or the Website’s interests.
- The operator may remove an ad without providing a specific reason, particularly if there is reasonable suspicion of a violation of the Terms of Service, the law, or the rights of third parties.
§9. Prohibited Content
- The following content is prohibited on the Website:
- illegal,
- false or misleading,
- that infringe on copyrights, industrial property rights, personal rights, or other rights of third parties,
- containing personal information of third parties without a legal basis,
- regarding homes that the manufacturer does not actually offer,
- who impersonate another entity,
- that include phone numbers in the ad text,
- that contain links to external websites in the ad text, unless this has been expressly permitted by the Operator,
- that are inconsistent with the Website’s profile,
- that could compromise the security of the Website,
- that contain malware, spam, or advertising content unrelated to the purpose of the Website.
- The manufacturer declares that it holds the rights to all photographs, renderings, floor plans, descriptions, trademarks, logos, and other materials submitted for publication on the Website.
- The Manufacturer’s acceptance of these Terms and Conditions constitutes confirmation that the materials it publishes do not infringe on the rights of third parties.
- If a violation is reported or if the Operator receives credible information that content violates the law or these Terms of Service, the Operator may take moderating actions, including, but not limited to, removing the content, restricting its visibility, blocking the listing, suspending the account, or requesting an explanation from the Producer.
§10. Posting Announcements and Moderation
- A user may report a listing that is outdated, false, unlawful, or in violation of the Terms of Service.
- You can submit your application:
- by using the “Report Ad” button, if available on the Website,
- by email to the following address: kontakt@housefactor.pl.
- The application should include:
- link to the ad,
- description of the violation,
- the contact information of the person filing the report, if necessary to clarify the matter,
- any evidence of the violation.
- The operator will review the report within a reasonable time and may take action appropriate to the nature of the violation.
- The Operator is not obligated to remove content solely based on a User’s subjective assessment if the content does not violate the law, these Terms of Service, or the rights of third parties.
- The manufacturer may be notified of the report and asked to provide an explanation or update the notice.
- The operator may use manual or automated moderation, including analysis of content for compliance with the Terms of Service, the Website’s profile, and platform security.
§11. Inquiries to Manufacturers
- The user can send an inquiry to the manufacturer using the form provided with the listing.
- To submit an inquiry, you must provide the information requested on the form and consent to the transfer of your data to the Manufacturer so that they may contact you.
- An example of the consent text might read:
“I consent to receiving a response from the homebuilder by phone and email. My data will be shared with the advertiser to facilitate communication. HouseFactor is the controller of my personal data.” - The data from the form is forwarded to a single, selected manufacturer.
- A manufacturer that receives an inquiry becomes a separate controller of the User’s personal data with respect to further communication and handling of the inquiry.
- HouseFactor may have access to the content of the query as the Site administrator.
- HouseFactor does not guarantee a response from the Manufacturer, the timing of such a response, the quality of service, or the conclusion of a contract between the User and the Manufacturer.
- The manufacturer does not have a deadline set by the Service for responding to inquiries.
- The user should independently verify the manufacturer, its offer, terms of cooperation, documentation, contract, warranty, construction technology, and all relevant parameters before making a purchase decision.
§12. Payments and Cooperation with Manufacturers
- Posting ads on the Polish-language version of the Website is free.
- Users can search for homes free of charge, and in accordance with the Site’s policy, this service is intended to remain free.
- There may be a fee for publishing announcements in select foreign language versions.
- A price list for paid services—including, in particular, publications, translations, promotion, and other additional services—is available upon request.
- You can submit a request for a paid collaboration using the form or by email to: kontakt@housefactor.pl.
- Payments for services related to foreign language versions are one-time payments, unless the parties agree otherwise.
- The scope of the paid service, its price, and the terms of service are specified in each instance in the price list, the offer, an email, the order, or another agreement between the Operator and the Producer.
- The manufacturer receives a VAT invoice for the services rendered.
- The manufacturer may opt out of the paid international version; however, such opt-out does not affect the obligation to pay for services already performed or commenced, unless the parties agree otherwise.
- The operator may offer selected language versions, translations, or foreign publications as a paid service, a free service, a promotional offer, or as a bonus included with other paid services.
§13. Language Versions and Translations
- The website can be available in multiple languages.
- The basic language versions include Polish and English. Other language versions may be available for a fee or as part of a promotion or other services.
- Translations of advertisements may be prepared by an external translator, using AI tools or other translation support tools.
- The advertiser is required to verify the accuracy of the translation of their ad before it is published or immediately after publication.
- The manufacturer is responsible for the accuracy, completeness, and conformity of the translation with the actual offer.
- In the event of any discrepancy between the Polish version of the announcement and a foreign-language version, the Polish version shall prevail.
- These Terms and Conditions are valid in their Polish language version. Any translations of the Terms and Conditions, if made available, are provided for reference only.
§14. AI Assistant
- The website may offer an AI Assistant feature to help Users search for, compare, or analyze listings.
- The AI assistant is designed to provide support and information.
- The AI Assistant’s responses may be generated automatically based on data available on the Website or information provided by the User.
- The AI Assistant’s responses do not constitute legal, technical, construction, financial, or investment advice, nor do they constitute a recommendation to purchase a specific home.
- Before making a decision, the User should independently verify all information directly with the Manufacturer or with the appropriate specialists.
- HouseFactor is not responsible for decisions made solely based on the AI Assistant’s responses.
§15. Blog and Informational Content
- The website may include a blog, guides, articles, educational materials, and other informational content.
- The content published on this blog is general, educational, and informational in nature.
- The content of this blog does not constitute legal, technical, design, construction, tax, financial, or investment advice.
- The operator makes every effort to ensure that the content is accurate and up-to-date; however, the user should always verify any information that affects their decisions with the appropriate specialists or directly with the manufacturer.
§16. Newsletter and Alerts
- Users can subscribe to the newsletter if this feature is available on the Website.
- The newsletter may contain information about the Website, new features, offers, articles, tips, marketing content, and announcements from the Operator.
- Users can also set up a search alert to receive notifications about new listings that match their selected criteria.
- Alerts are sent via email.
- To use alerts, you must create an account.
- Users may unsubscribe from the newsletter or alerts as indicated in the email or on the Website.
- To manage the newsletter and email communications, the Operator may use GetResponse or other email marketing tools.
§17. Copyright and License for the Producer’s Materials
- All elements of the Website, including its name, layout, graphics, logos, text, features, database, software, and other elements, are protected by law.
- The user may not copy, distribute, modify, bulk download, scrape, use for commercial purposes, or create competing databases based on the content available on the Website without the Operator’s prior consent.
- By publishing an advertisement or submitting materials to the Website, the Producer represents that it holds full rights to such materials and that their publication does not infringe on the rights of third parties.
- The Producer grants the Operator a royalty-free, non-exclusive, geographically unlimited license to use the materials submitted to the Website to the extent necessary to:
- publication of the announcement,
- presentation of the offer on the Website,
- creating thumbnails,
- adapting photos and graphics to the Website’s formats,
- preparing summaries and descriptions,
- content translation,
- promotion of the Website and online ads,
- publishing content on social media, in newsletters, in advertisements, and through other HouseFactor marketing channels.
- The license covers, in particular, photographs, renderings, floor plans, descriptions, technical specifications, logos, trade names, and other materials provided by the Manufacturer.
- The producer may remove an advertisement from the Website; however, the removal of an advertisement does not affect the legality of the Operator’s prior use of the materials during the term of the license.
- In the event of third-party claims regarding materials provided by the Manufacturer, the Manufacturer agrees to cooperate with the Operator to resolve the matter and shall be liable for any violations arising from the materials provided.
§18. Personal Information

- Personal data is processed, in particular, for the following purposes:
- the provision of services electronically,
- managing User and Producer accounts,
- publication of announcements,
- contact form processing,
- forwarding inquiries to manufacturers,
- alert management,
- newsletter mailings,
- handling complaints and reports,
- conducting analytical and marketing activities,
- to ensure the security of the Website,
- investigations or defense against claims.
- The User’s information who submits an inquiry is forwarded to the selected Manufacturer to enable contact and to process the inquiry.
- Upon receiving the User’s data, the Manufacturer becomes a separate controller of personal data with respect to further communication, handling inquiries, and any potential cooperation with the User.
- The Provider is required to process personal data received from the Website in accordance with applicable law, in particular the provisions of the GDPR, solely for the purpose of handling the User’s inquiry, unless it has another legal basis for further processing.
- The provider may not use User data obtained through the Website for unlawful purposes or for unsolicited marketing communications, nor may it disclose such data to other entities without a legal basis.
- Detailed information regarding the processing of personal data, cookies, and analytical and marketing tools can be found in the Website’s Privacy and Cookies Policy.
§19. Cookies, Analytics, and Marketing
- The Website may use cookies and similar technologies to ensure the proper functioning of the Website, to collect statistics, perform analytics, conduct marketing and remarketing activities, and improve the quality of services.
- In particular, the website may use tools such as:
- Google Analytics,
- Google Tag Manager,
- Google Ads,
- Meta Pixel,
- GetResponse,
- other tools listed in the Privacy and Cookies Policy.
- The website does not use cookies to save favorite listings and alerts if these features require users to create an account.

§20. Operator Liability
- The Operator is responsible for the proper provision of electronic services through the Website in accordance with the terms set forth in the Terms of Service and applicable laws.
- The operator is not liable for:
- the content of advertisements published by manufacturers,
- the timeliness, completeness, and accuracy of the offers,
- the quality of the homes offered by builders,
- the actual availability of the home or model,
- prices, promotions, discounts, and terms and conditions of manufacturers,
- the timeliness of the manufacturer’s response,
- the course of negotiations between the User and the Manufacturer,
- whether or not a contract is concluded between the User and the Manufacturer,
- the Manufacturer’s performance or non-performance of the contract,
- advance payments, payments, and settlements between the User and the Producer,
- warranties, guarantees, and complaints regarding the house,
- Decisions made by the User based on advertisements, materials, blog content, or responses from the AI Assistant.
- The Operator shall not be liable for any lost profits incurred by the User or the Manufacturer, unless otherwise provided by mandatory provisions of law.
- The Operator shall not be liable for any interruptions in the operation of the Website resulting from causes beyond the Operator’s control, malfunctions, force majeure, technical work, actions of third-party service providers, or actions of third parties.
- Limitations of liability do not affect consumers’ rights under mandatory provisions of law.
§21. Complaints Regarding the Operation of the Website
- A user or a manufacturer may file a complaint regarding the operation of the Website.
- Complaints should be submitted to the following email address: kontakt@housefactor.pl.
- A complaint should include:
- the first and last name or the name of the applicant,
- email address,
- description of the problem,
- the date the problem occurred,
- any screenshots or other supporting materials.
- The operator will review the complaint within 14 days of receiving it.
- Complaints apply exclusively to the operation of the Website and the services provided by the Operator.
- Complaints regarding the quality of the home, the content of the offer, the price, the terms of performance, warranties, guarantees, advance payments, payments, deadlines, or the performance of the contract should be directed to the Manufacturer.
§22. Withdrawal from the Contract and Paid Services
- To the extent that the Website provides paid services, the terms and conditions for their provision are set forth in the Terms of Service and in individual agreements between the Operator and the Producer.
- If a paid service is ordered by a business and is of a professional nature related to its operations, the provisions regarding the consumer’s right to cancel the contract may not apply.
- If mandatory legal provisions grant a given party the right to withdraw from the contract, the Operator shall apply those provisions.
- If the service begins before the expiration of any applicable withdrawal period, the terms for settling the service are governed by applicable law and the agreements between the parties.
§23. Security and Prohibited User Activities
- It is prohibited to use the Website in any of the following ways:
- in violation of the law,
- in violation of the Terms of Service,
- that disrupts the operation of the Website,
- that infringes the rights of the Operator, Producers, Users, or third parties,
- involving the mass collection of data,
- involving scraping, copying, or reproducing the classifieds database,
- involving the circumvention of the Website’s security measures,
- involving the sending of spam or malware,
- involving the use of the Website for competitive purposes without the Operator’s consent.
- The Operator may block access to the Website, an account, or certain features for any person who violates the Terms of Service.
§24. Amendments to the Rules and Regulations
- The Operator has the right to amend the Terms and Conditions for valid reasons, in particular in the event of:
- changes in the law,
- changes to the Website’s features,
- changes to the Website’s operating model,
- the introduction of new services,
- changes to payment policies,
- the need to clarify the provisions,
- the need to improve the security of the Website.
- The new version of the Terms and Conditions will be published on the Website.
- Users and Manufacturers with an account may be notified of changes to the Terms of Service via email or through an announcement on the Website.
- Use of the Website after the changes take effect constitutes acceptance of the new version of the Terms of Service.
- If a User or Producer does not accept the changes to the Terms of Service, they should stop using the Website and may request that their account be deleted.
§25. Final Provisions
- These Terms and Conditions are effective as of the date of their publication on the Website.
- In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply.
- These Terms and Conditions were drafted in Polish.
- If these Terms and Conditions are made available in other languages, the Polish version shall be the binding version.
- Any disputes shall be resolved by the competent courts of general jurisdiction, in accordance with applicable law.
- No provision of these Terms and Conditions is intended to limit the consumer’s rights under mandatory provisions of law.
- The current version of the Terms and Conditions is available on the Website in a format that allows it to be downloaded, saved, and accessed free of charge.
